Шановні європейські та міжнародні партнери!
Я звертаюся до вас від імені партії «Батьківщина» з метою роз’яснити нашу позицію щодо законодавчих ініціатив, спрямованих на збереження незалежності антикорупційних інституцій України – зокрема, президентського законопроєкту №13533, який найближчим часом буде розглянуто у Верховній Раді України, та альтернативного законопроєкту №13533-3, зареєстрованого нашою парламентською фракцією.
Ми рішуче підтримуємо зусилля зі зміцнення незалежності судової та правоохоронної систем України, зокрема її антикорупційних органів. Інституційна незалежність цих органів є однією з ключових передумов верховенства права та європейської інтеграції України. Протягом багатьох років ми послідовно голосували за ключові закони, що створили нову антикорупційну архітектуру держави.
Однак через одинадцять років після створення НАБУ навіть українські неурядові антикорупційні організації визнають, що рівень корупції не знизився – а в окремих секторах навіть поглибився. Наприклад, за даними Transparency International Ukraine, рівень системної корупції залишається високим, а ефективність новостворених інституцій – недостатньою.
Ми переконані, що антикорупційну реформу – як і будь-яку іншу – слід оцінювати не за кількістю створених органів, а за результатами їхньої діяльності. На жаль, українське суспільство досі не побачило відчутних результатів. Згідно з опитуваннями громадської думки, 60% українців не довіряють антикорупційним органам. Натомість 95% громадян довіряють Збройним Силам України.
Глибоке занепокоєння викликає практика, яка закріпилася останніми роками: міжнародні експерти отримали не лише право блокувати рішення, але й вирішальний вплив на призначення керівництва ключових державних органів – таких як НАБУ, САП, Вища рада правосуддя, Конституційний та Верховний суди, Рахункова палата, Антимонопольний комітет та інші. Деякі з цих експертів ніколи не були в Україні і не обізнані з її правовим і безпековим контекстом. Така практика не має аналогів у жодній державі-члені ЄС або G7.
Ми вважаємо, що подібні підходи можуть бути доречними лише у виняткових випадках – після конфліктів або у разі краху інституцій, як-от у Ліберії, Сьєрра-Леоне, Афганістані, Косово чи Боснії і Герцеговині. Але Україна – не «failed state», як це намагається представити Кремль. Ми – суверенна європейська нація, яка героїчно чинить опір повномасштабній агресії та зі зброєю в руках захищає цінності Європи.
Обидва законопроєкти – і президентський, і наш – зберігають незалежність антикорупційних органів. Проте між ними існує принципова відмінність: президентський проєкт надає іноземним членам міжнародних дорадчих рад вирішальну роль у формуванні та доборі керівництва цих органів.
Наш альтернативний законопроєкт №13533-3 пропонує передати це право новому незалежному органу – Національній асамблеї Героїв України, до складу якої входять воїни, що отримали звання Героя України безпосередньо на полі бою, захищаючи суверенітет, територіальну цілісність та європейське майбутнє нашої держави.
Ми твердо переконані, що саме ці особи – незалежні, жертовні, широко шановані в суспільстві – мають моральне право бути гарантами доброчесності та справедливості. Це – наша українська відповідь на виклик чесного врядування в умовах війни. Антикорупційна доброчесність – це не зовнішній аудит, а внутрішня совість воюючої нації. Ті, хто дивився в очі смерті, мають право визначати справедливість і її захищати.
Партія «Батьківщина» завжди була і залишається послідовним прихильником вступу України до Європейського Союзу та НАТО. Водночас ми переконані, що демократичний суверенітет, гідність і рівноправне партнерство – це невід’ємні європейські цінності, які ми маємо разом захищати.
У цьому контексті варто згадати слова одного з батьків-засновників європейського проєкту – Альчіде де Гаспері: «Ми будуємо Європу не для того, щоб стерти нації, а щоб гарантувати їхнє існування, гідність і майбутнє».
Саме за це ми боремося сьогодні.

Dear European and International partners,
I am reaching out to you on behalf of the Batkivshchyna Party to clarify our position regarding the legislative proposals aimed at safeguarding the independence of Ukraine’s anti-corruption institutions – specifically, the presidential draft law No. 13533, which will soon be considered by the Verkhovna Rada of Ukraine, and the alternative draft law No. 13533-3, registered by our parliamentary faction.
We strongly support efforts to strengthen the independence of Ukraine’s judiciary and law enforcement system, including its anti-corruption bodies. The institutional independence of these bodies is a fundamental precondition for the rule of law and for Ukraine’s European integration. Over the years, we have consistently voted in favor of key laws that helped establish the country’s new anti-corruption architecture.
However, eleven years since the creation of NABU, even Ukraine’s own non-governmental anti-corruption organizations acknowledge that corruption has not been reduced – and in some sectors, has even deepened. For instance, according to Transparency International Ukraine, the level of systemic corruption remains high, while the performance of newly established institutions remains insufficient.
We are convinced that anti-corruption reform – like any reform – should be judged not by the number of institutions created, but by the effectiveness of their work. Unfortunately, Ukrainian society has yet to see tangible results. According to public opinion polls, 60% of Ukrainians do not trust the anti-corruption institutions. Meanwhile, 95% express trust in the Armed Forces of Ukraine.
We are deeply concerned by the practice that has taken root in recent years: international experts have been granted not only blocking powers, but decisive influence over the appointment of leadership in key state bodies – including NABU, SAPO, the High Council of Justice, the Constitutional and Supreme Courts, the Accounting Chamber, the Antimonopoly Committee, and others. Some of these experts have never been to Ukraine and are unfamiliar with its legal and security context. Such practice has no precedent in any member state of the European Union or the G7.
We believe that such approaches may be appropriate only in exceptional cases of post-conflict recovery or institutional collapse – as in Liberia, Sierra Leone, Afghanistan, Kosovo, or Bosnia and Herzegovina. But Ukraine is not a failed state, as the Kremlin tries to portray it. We are a sovereign European nation, heroically resisting full-scale aggression and defending the values of Europe with weapons in hand.
Both legislative proposals – the presidential one and ours – preserve the independence of anti-corruption institutions. However, the difference is fundamental: The presidential draft grants foreign members of international advisory boards decisive power in forming and selecting the leadership of these bodies.
Our alternative draft law No. 13533-3 proposes to transfer this right to a new independent body – the National Assembly of Heroes of Ukraine, composed of soldiers who received the title “Hero of Ukraine” directly on the battlefield for defending the sovereignty, territorial integrity, and European future of our state.
We firmly believe that these individuals – unaligned, selfless, and widely respected in society – have the moral right to serve as guarantors of integrity and justice. This is our Ukrainian response to the challenge of ensuring honest governance in wartime. Anti-corruption integrity is not an external audit – it is the inner conscience of a nation at war. Those who have looked death in the face have the right to define justice and to protect it.
Batkivshchyna has always been, and remains, a committed advocate of Ukraine’s accession to the European Union and NATO. Yet we also believe that democratic sovereignty, dignity, and equal partnership are inseparable European values that we must jointly uphold.
In this context, it is worth recalling the words of Alcide De Gasperi, one of the founding fathers of the European project: “We are not building Europe to erase nations, but to guarantee their existence, dignity, and future.”
That is precisely what we are fighting for today.
